Powerlifting America Terms of Use

Welcome to the official website of Powerlifting America located at www.powerlifting-america.com (the “Site”), operated by Powerlifting America (“Powerlifting America,” “we,” “us,” or “our”). Powerlifting America is the recognized national governing body for the sport of powerlifting in the United States and the official member federation of the International Powerlifting Federation (IPF) in the United States.

These Terms of Use (“Terms”) govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site. Please read these Terms carefully before using the Site. By accessing or using the Site, you accept and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Site.

1. Use of the Site

This Site is offered and available to users who are 13 years of age or older. By using this Site, you represent and warrant that you are at least 13 years old or are using the Site with the permission and under the supervision of a parent or legal guardian. You further represent and warrant that you are of legal age to form a binding contract with Powerlifting America and meet all other eligibility requirements. If you do not meet these requirements, you must not access or use the Site.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes. You may not use the Site for any illegal or unauthorized purpose.

2. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Powerlifting America, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

The Powerlifting America name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Powerlifting America or its affiliates or licensors. You must not use such marks without the prior written permission of Powerlifting America.

3. Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
• To impersonate or attempt to impersonate Powerlifting America, a Powerlifting America employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Powerlifting America or users of the Site.

Additionally, you agree not to:

• Use any robot, spider, or other automatic device, process, or means to access the Site for any purpose without our express written permission.
• Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site or any server, computer, or database connected to the Site.

4. User Contributions

The Site may contain message boards, forums, membership portals, personal profiles, and other interactive features (collectively, “Interactive Services”) that allow users to post, submit, publish, display, or transmit content or materials (collectively, “User Contributions”).

All User Contributions must comply with the content standards set out in these Terms. By posting User Contributions, you grant Powerlifting America a perpetual, irrevocable, royalty-free, worldwide license to use, modify, publish, and distribute such content for any purpose.

You represent and warrant that you own or control all rights in and to your User Contributions and that they do not violate the rights of any third party.

5. Monitoring and Enforcement

We have the right to:

• Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
• Take any action with respect to any User Contribution that we deem necessary or appropriate.
• Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights.
• Terminate or suspend your access to all or part of the Site for any violation of these Terms.

6. Disclaimer of Warranties

YOUR USE OF THE SITE IS AT YOUR OWN RISK. THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. POWERLIFTING AMERICA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

IN NO EVENT WILL POWERLIFTING AMERICA, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the federal or state courts located in Orange County, Florida.

9. Changes to the Terms

We may revise these Terms at any time by updating this posting. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
